What is an Advance Ruling?

A decision provided by Customs to an applicant prior to the importation of a good covered by the application indicating how the goods will be treated

Who can apply for an Advance Ruling?

Importer,
Exporter,
A person, or authorized agent of a person, who has a demonstrable interest in the questions presented

What types of Advance Rulings can I apply for?

Tariff classification
Rules of origin

Why should I request an Advance Ruling?

Decision binding on Customs for future importation
Decision provides greater predictability and consistency for the trade
It reduces disputes as decision is made prior to importation
Decision allows for the quicker release of the goods

How do I apply for an Advance Ruling?

You can apply online using the url ‘external.unipassghana.com’
You will be required to register if not already registered on ICUMS using your Ghana Card or TIN

How many products or issues can I request an Advance Ruling for in one application?

Five (5) products or five (5) issues.
More than five (5) products or issues require separate applications

Is there a fee to apply for an Advance Ruling?

No

Responses/Actions that Customs may take on an application

Accept the proposals/request of the applicant
Modify the proposal/request of the applicant
Issue entirely different decision but based on applicant information
Decline application

Are advance ruling decisions appealable?

Yes, within thirty (30) days of the issuance of the decision

How long will it take Customs to issue an Advance Ruling?

Within ninety (90) days when all documentations are up

When will an advance ruling take effect?

Largely effective from the date they are issued

How long will an Advance Ruling stay in effect?

Binding until overturned by the Commissioner

What are the grounds for overturning an advance ruling?

If the decision was based on false and incorrect information
If there are changes in fact and law
If a new judicial decision come into effect
If there is a change in interpretation of fact and/or law by Customs

Will the rules of natural justice be complied with before an advance ruling decision is over turned?

Yes
Customs will give prior written notice to the applicant/recipient
Applicant or recipient will have the opportunity to defend him/herself

Will advance rulings be published?

Yes; taking cognisance of all confidentiality requirements
